NTCB Privacy Policy

This privacy policy describes how the Neonatal Therapy Certification Board (NTCB) uses information collected through its website, www.neonataltherapycertification.com, as well as information collected offline. The NTCB will update this policy as needed and inform users by posting the updated version of this policy on its website. Users of the NTCB website agree to this privacy policy.

The NTCB requires users to submit personally identifying information to receive materials, create user accounts, and apply for certification or recertification. This includes information such as the user’s name, email address, phone number, and place of employment. More extensive information is required from applicants applying for certification and recertification.

The NTCB maintains a public directory of Certified Neonatal Therapists (CNTs) which includes the name and practice location of each CNT. The NTCB retains user information to ensure proper use of the website and for management and administration of NTCB’s services. This may include analysis of de-identified data from the certification process in order to continue to refine and develop the services provided by the NTCB.

Use of Information by Third Parties

The NTCB endeavors to work only with reputable partners when completion of a requested transaction requires sharing information with a credit card company, credentialing agency or other outside party, such as the exam administrator. This website may include applications and links to websites owned by third parties. This policy does not apply to third parties, and NTCB is not responsible for the practices of third parties.

You may review and edit your account information at any time by logging in and going to your account page.

Security of Information

The NTCB uses safeguards to protect personally identifying information in its records. Encryption is used to protect sensitive information submitted through this website, such as credit card numbers. NTCB maintains the right to provide verification of CNT status with others requesting information on a specific certificant. NTCB maintains the right to share information with third parties who administrate parts of the certification process, such as the exam administrator.

Operations of the NTCB are located primarily in the United States. Information submitted through this website will be transferred from the country where the user is located to the United States, and therefore be under the jurisdiction of laws in the United States.

All information submitted on the NTCB website or developed as part of the certification process becomes the property of NTCB. By submitting information and/or engaging in the process of certification, you agree that such information may be used for evaluation of the certification process, determining psychometrics of the certification examination, assessing descriptives of the certificant and potential certificant pool, and other activities as deemed necessary for the administration of the certification program.

The NTCB assumes no responsibility for consequences resulting from use of the information contained herein or obtained at linked sites or via other information provided by the NTCB, and expressly disclaims all liability for damages arising out of use, reference to, reliance on, or performance of such information.

Acceptance of Terms

The following Terms of Service Agreement (the “TOS”) is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with the Neonatal Therapy Certification Board, also known as the NTCB, in association with the use of the NTCB website, which includes www.neonataltherapycertification.com (the “Site”), and its Services, which shall be defined below.

Description of Website Services Offered

All visitors to our site, www.neonataltherapycertification.com, despite whether they are registered or not, shall be deemed as “users” of the herein contained Services for the purpose of this TOS.

The user acknowledges and agrees that the Services provided and made available through our website and applications, which may include mobile applications, which may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of the NTCB. At its discretion, the NTCB may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified or revised Services unless otherwise stipulated.

Registration

To register and become a “user” of the Site, you must be at least 18 years of age to enter into and form a legally binding contract. In addition, you must not be an individual who has been previously barred from receiving the NTCB’s Services under the laws and statutes of the United States or other applicable jurisdiction.

When you register, the NTCB may collect information such as your name, e-mail address, mailing address, occupation, discipline, and workplace. You can edit your account information at any time. Once you register with the NTCB and sign in to our Services, you are no longer anonymous to us.

Furthermore, the registering party hereby acknowledges, understands and agrees to furnish and maintain factual, correct, current and complete information with regards to yourself as may be requested by the data registration process, or the NTCB may suspend or terminate the user in violation of this aspect of the Agreement, and as such refuse any and all current or future use of the NTCB Services, or any portion thereof.

As a user, you herein consent to the collection and use of the information provided, including the transfer of information within the United States and/or other countries for storage, processing or use by THE NTCB and/or our subsidiaries and affiliates.

User Account, Username, Password and Security

When you set up an account, you are the sole authorized user of your account. You shall be responsible for maintaining the secrecy and confidentiality of your password and for all activities that transpire on or within your account.

Conduct

You herein agree not to make use of the NTCB’s Services for any objectionable purpose. The NTCB reserves the right to access, preserve and/or disclose user account information and/or content if it is required to do so by law. The NTCB reserves the right to include the use of security components that may permit digital information or material to be protected, and that such use of information and/or material is subject to usage guidelines and regulations established by the NTCB or any other content providers supplying content services to the NTCB. You are hereby prohibited from making any attempt to override or circumvent any of the embedded usage rules in our Services. Furthermore, unauthorized reproduction, publication, distribution, or exhibition of any information or materials supplied by our Services, whether done so in whole or in part, is expressly prohibited. Because of the confidential nature of the examination, I agree to not make or keep copies, excerpts, or notes of examination materials, and to not use or divulge information learned from the examination. The examination is the exclusive property of NTCB and I will not use it in any way without the express prior written consent of NTCB.

Indemnity

All users agree to insure and hold the NTCB, our subsidiaries, affiliates, agents, employees, officers, partners and/or licensors harmless and not liable for any claim or demand.

Commercial Reuse of Services

The user herein agrees not to replicate, duplicate, copy, trade, sell, resell nor exploit for any commercial reason any part, use of, or access to the NTCB’s sites.

Use and Storage General Practices

You herein acknowledge that the NTCB may set up any such practices and/or limits regarding the use of our Services. You also herein acknowledge that we reserve the right to delete or remove any account that is no longer active for an extended period of time. Furthermore, the NTCB reserves the right to modify, alter and/or update these general practices and limits at our discretion.

Termination

As a user of www.neonataltherapycertification.com you may cancel or terminate your account, associated email address and/or access to our Services by submitting a cancellation or termination request to [email protected]. As a user, you agree that the NTCB may, at our discretion, without any prior written notice, immediately suspend, terminate, discontinue and/or limit your account, any email associated with your account, and access to any of our Services. Notice

THE NTCB may furnish you with notices, which may not be received if you violate any aspects of the TOS by accessing our Services in an unauthorized manner. Your acceptance of this TOS constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed our Services in an authorized manner.

Trademark Information

You herein acknowledge, understand and agree that all of the NTCB trademarks, copyright, trade name, service marks, logos, any brand features, and/or product and service names are trademarks and as such, are and shall remain the property of the NTCB. You herein agree not to display and/or use in any manner the NTCB logo or marks without obtaining our prior written consent.

General Information

Choice of Law and Forum

It is at the mutual agreement of you and the NTCB with regard to the TOS that the relationship between the parties shall be governed by the laws of the State of Iowa without regard to its conflict of law provisions and that any and all claims, causes of action and/or disputes, arising out of or relating to the TOS, or the relationship between you and the NTCB shall be filed within the courts having jurisdiction within Polk County, Iowa or the U.S. District Court, Southern District of Iowa located in said state.

Waiver And Severability of Terms

At any time, should the NTCB fail to exercise or enforce any right or provision of the TOS, such failure shall not constitute a waiver of such right or provision. If any provision of this TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

Statute of Limitations

You acknowledge, understand and agree that regardless of any statute or law to the contrary, any claim or action arising out of or related to the use of our Services or the TOS must be filed within 1 year(s) after said claim or cause of action arose or shall be forever barred.
